REQUEST FOR PROPOSALS FOR LEGAL SERVICES
FOR THE
HOUSING AUTHORITY OF THE CITY OF PRICHARD (HACP)
I. Purpose. The Housing Authority of the City of Prichard (HACP) is seeking proposals from qualified individuals and legal firms to provide legal services for various matters relating to HACP. Proposals may include all or part of the services described below. HACP may withdraw this Request for Proposal (RFP) at any time and may re-issue or revise this RFP with reasonable notice.
II. Background. The Housing Authority of the City of Prichard is a local public housing corporation organized under the Housing Authorities Law of the State of Alabama with a five-member Board of Commissioners. HACP is charged with the responsibility of providing housing to low-income persons and operates primarily through three programs: 1) Rental Assistance Demonstration Program (RAD PBRA) 2) Public Housing, and 3) Section 8 Housing Choice Vouchers Program. HACP also operates other programs such as HOME, HOPE I, HOPE II, HOPE VI, Section 8 Contract Administration, Low Income Housing Tax Credits (LIHTC), Section 5(H) and Section 32 Homeownership Programs, etc.
Legal services relating to public housing include landlord-tenant issues as well as federal housing law. Legal services relating to Section 8 rental assistance include informal settlements of landlord damages claims as well as issues relating to certification of participants. Legal services may also include litigation matters relating to personal injuries, real estate, contract and other types of legal matters. Matter will be assigned to counsel on an hourly basis.
III. The Process. Properly sealed and labeled written proposals should be delivered to 200 W Prichard Avenue, Prichard, Alabama 36610 no later than 12:00 noon on Friday, April 10, 2026. All offers are subject to the provisions set forth herein or incorporated herein by reference. HACP reserves the right to reject any and all proposals. Upon acceptance of a proposal, HACP will enter into a formal contract suitable to HACP for the services of the person or firm selected. In accordance with HUD regulatory policy, the term of said contract may not exceed two years but may have three successive annual renewals.
IV. Scope of Service. The services required will include:
A. Drafting general contracts and other instruments for HACP.
B. Advising HACP on compliance with Federal, State and Local laws and regulation, including particularly compliance with HUD regulatory requirements.
C. Representing HACP when requested in litigation or negotiation.
D. Advising HACP on matters of public employment and other employment law.
E. Advising HACP on the Federal Housing Programs, including but not limited to Affordable Housing Programs, Tax Credit Financing using Low Income Housing Tax Credits and tax law in connection with joint ventures with private and nonprofit entities or projects to provide housing for low- and moderate-income persons.
F. Providing all other necessary legal services to ensure compliance with Federal, State and Local laws and regulations, including particularly compliance with HUD regulatory requirements.
G. Handling the eviction of tenants and legal services or both.
V. Evaluation Factors.
1. Evidence of the lawyer's or firm's ability to perform the work, as indicated by profiles of the principals and staff, and professional and technical competence and experience including previous experience in the legal representation of Public Housing Authorities, including particularly HUD policies and regulations, and administrative Law in general.
2. Capability to provide professional services in a timely manner.
3. Evidence that the lawyer or principal in the firm is licensed as a lawyer in the State of Alabama and holds all other appropriate licenses and professional certificates needed to perform the work.
4. Past performance in terms of cost control, quality of work, and compliance with performance schedules.
5. Knowledge of Federal, State, and Local laws and regulations in the public employment and public housing areas.
6. Knowledge of real estate laws and environmental laws.
7. Knowledge of Federal Tax Laws, including knowledge of laws governing low income tax credit.
8. Knowledge of Laws governing borrowing by public authorities such as HACP.
9. Certified statement that the lawyer or firm is not barred suspended or otherwise prohibited from professional practice by any Federal, State or Local agency.
10. Knowledge of bankruptcy laws, specifically including the representation of creditors in bankruptcy proceedings.
11. Knowledge of employment law, including ADA, FMLA, due process requirements, the whistleblower's statue, discrimination law, workers' compensation laws, OSHA and FLSA and other related areas.
12. Knowledge of general state law regarding local government entities, including but not limited to the Alabama Tort Claims Act, Open Meetings Act, Open Records Act, Competitive Bidding Procedures, and Housing Authorities Law.
13. Knowledge of laws governing landlord-tenant relations, specifically including evictions and familiarity with Federal Housing Laws, policy drafting and interpretation, administrative law, applicable Federal Regulations and tenant grievance procedures, criminal law, criminal procedure. Must be a member of the bar in good standing in state and federal courts.
14. Price (optional factor); and
15. Other factors determined to be appropriate by HACP.
VI. General Requirements. The following requirements apply to all responders desiring consideration under the proposed contract:
A. Legal Compliance. The responder must comply with all Federal, State and Local laws, regulations, and ordinances.
B. Minority Participation - Where possible and appropriate, HACP intends to use the services of small minority and female owned firms and disadvantaged individuals and firms, provided that such individuals and firms are able to perform the work required and meet the other requirements and needs of HACP.
C. Conflict of Interest-The firm represents that no person who currently exercises any function or responsibility in connection with HACP has any direct personal
financial interest in the contract to the awarded or in the firm making the proposal.
The firm further represents that none of its employees, principals or agents, has or will give gratuities, favors or anything of monetary value to the officers, employees or agents of HACP.
D. Board Meetings - Must attend meetings of the Board of Commissioners and, if requested, various committee meetings.
E. Legal firms must quote the hourly rate that will be charged HACP to provide the representation outlined in the RFP.
VII. Firm Information - Each proposal should contain responses to the following items:
A. Organization and Experience
o Name of firm, address, telephone number and person to contact
o Type of legal services firm is experienced in
o Brief history of firm
o List of key principals, director, or partners
o Biographies of key personnel
o Evidence of license to practice law in the State of Alabama
B. Staffing Plan
o Evidence of the capacity of the firm and its staff to perform the type of services requested in a timely manner
o Names (including race and gender) and categories of persons to be assigned to the work including supervisors
VIII. Pricing - Request for Proposals should also include the hourly rate to be charged and the hourly rate charged by each member and/or associate of the firm and legal support staff for services provided, and for such matters as outlined but not included under the retainer, excluding non-contested forcible entry and detainer actions and a schedule of the related charges, such as copy, fax charges, and any surcharges for filing and delivery service.
IX. Evaluation Process - Response will be evaluated based on relevant experience, responder integrity, compliance with public policy, technical qualifications, financial resources, quality of work and the price of service.
A. Relevant experience and technical qualifications should be thoroughly demonstrated in the proposal using specific examples where possible.
B. HACP may investigate the quality of work by contacting other clients. Staffing proposals may also affect perceived quality of work offered and therefore, should be as specific as possible, prior approval by HACP is required for outside consultants or associates.
C. Prices for services will be compared. Price may be affected by staffing proposals if rates vary for different classes of personnel (principals, associates, etc.). For those items of repetitive work and other legal work receptive thereto, fixed fee or unit pricing is preferred.
X. Certification - A certification that all provisions contained herein are acceptable to the firm must accompany each proposal.
